Your access to and use of this website is subject to legally binding terms and conditions. Carefully read the following terms and conditions before accessing or using this website. Your accessing or use of this website indicates your acceptance of the following terms and conditions and your agreement to be bound by them. The following terms and conditions form a binding agreement (“Agreement”) between you and Mond Women. We may change these terms and conditions at any time without advance notice. Changed terms will become effective once posted on this website. Your continued use of this website after any change means you have accepted the changed terms and conditions.
Being Safe
In line with current NSW health orders for covid protocols Mond Women suggests wearing a mask into the studio, but once practice begins if you would like to, you may remove your mask. Monique will ask you prior to class whether you would like her to use a mask when assisting you in your movement. Hand sanitiser will be used in between client adjustments.
You are urged and advised to seek the advice of a physician if you have specific reasons for attending classes at Mond Women, before beginning any engagement of Mond Women classes, private classes or any of the video clips on the Website. Mond Women is not a medical organisation and its instructors or staff cannot give you medical advice or diagnosis, we can only offer support and suggestions to improve your health and wellbeing. All suggestions and comments relating to the use of equipment, poses, breathing and movement instruction are not required to be performed by you and are carried out at your election while viewing Mond Women videos. Nothing contained in this Website should be construed as any form of such medical advice or diagnosis.
By using the Mond Women Website you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in classes and activities from Mond Women, you will not exceed your limits while performing such activity, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.
You expressly waive and release any claim that you may have at any time for injury of any kind against Mond Women, or any person or entity involved with Mond Women, including without limitation its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.
Terms of Visiting Mond Women
These are the rights and responsibilities applied to clients, visiting the facilities of Mond Women studio, as stated below:
1.It is a condition of us allowing you to obtain a class pass, class packages and/or enter Mond Women, that you agree to our Terms and Conditions.
2. By obtaining a class pass, class packages or otherwise physically entering Mond
Women, you agree to be bound by the Terms and Conditions. If you do not agree with these Terms and Conditions, you should not obtain a class pass, class packages or enter Mond Women.
3. These Terms and Conditions can be amended by Mond Women at any time. We will notify you in writing of any changes to the Terms and Conditions by email, on our website or otherwise at Mond Women. You should familiarise yourself with these Terms and Conditions and check for updates regularly.
4. Mond Women reserves the right to refuse entry to, or eject you from the property for any reason.
5. Participating in any form of exercise, workshop, or consult at Mond Women is done entirely at your own risk. All those attending classes are advised to seek medical advice prior to commencing any exercise program if they are in any doubt about their ability to engage in exercise.
6. You must inform us and any instructors if there are any risks to your health by participating in yoga practice, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement (a “Medical Condition”). Where you have a Medical Condition, we strongly recommend that you seek approval from a medical practitioner to participate in any of our classes. Participating in any form of exercise at Mond Women with a Medical Condition is done entirely at your own risk.
7. You acknowledge that our instructors may make physical contact with you for correction purposes in order to ensure that your yoga practice is undertaken in accordance with known methods and body alignment. Not communicating a preference for no adjustment or contact, for method or alignment, is completely at your own risk.
8. We are not liable in any way to provide you with a refund, credit, transfer, or to offer compensation of any kind, for classes that are not held in accordance with the class schedule, but may choose to do so at our sole discretion.
9. We reserve our right to change our opening hours, on any given day without notice to you. You will be notified of any permanent changes to our opening hours.
10. We are not responsible in any way for the safekeeping of your personal belongings. We recommend that you bring only any personal belongings into Mond Women which are absolutely necessary for you to possess for the duration of your visit.
11. You are not permitted to interfere or tamper with, steal, or cause loss or damage to, the personal belongings of another person at Mond Women. If you do so, we may cancel your class pass or package and permanently ban you from entering Mond Women.
12. Mond Women complies with the Privacy Act, our policy is included on this website. If you wish to request access to your personal information, correct or update your details or raise any privacy concerns you may have, please contact us at hello@mondwomen.com
13. We use a third party client management software called “Wix Bookings”. In order to create a membership or book a class, your personal information will be provided to Wix. The collection and use of personal information by Wix is governed by Wix’s privacy policy.
14. To ensure you can attend a class, you must pre-book your attendance to any classes held at Mond Women using the online booking system available on our website or mobile application. All class attendance must be pre-booked. No casual entry is permitted.
15. If you have booked to attend a class and wish to cancel your attendance, you must process a cancellation through the Online Booking System only. In order to cancel your attendance without penalty, you must process a cancellation using the Online Booking System up to 16 hours prior to the scheduled commencement time for the class as detailed in our Class Schedule (“Early Cancellation Window”). We will not accept cancellations by phone, e-mail or any other method other than by using the Online Booking System.
16. The sale of a class package is final. To the extent permitted by law, we do not offer any refunds on the cost of class packages for change of mind, user error, injury, illness, change of address, unsuitability or any other reason.
17. Class packages are sold or otherwise provided to patrons of Mond Women for personal use only. Class packages are non-transferable and must not be sold, traded, gifted, shared, provided or otherwise transferred to any other person. If we discover that you are engaging in any of these activities, we reserve the right to cancel your class package permanently and ban you from visiting any Mond Women indefinitely.
18. We offer gift cards for sale which can be redeemed for the secession of class packages. Gift cards are not redeemable for cash.
19. We reserve the right to increase fees for ongoing classes at any time. We will notify you in writing of any changes to the pricing details of classes.
20. We reserve the right to change our fees applicable to purchasing new class packages at any time. We will notify you of any changes to the pricing of class packs in writing.
21. Our Services come with consumer guarantees under the Australian Consumer Law (“ACL”). With the exception of consumer guarantees found under the ACL and other laws which cannot be excluded and to the extent permitted by law, we exclude any term, condition or warranty that may otherwise be implied into these Terms and Conditions or relating to our Services.
22. To the extent permitted by law:
a. Mond Women and its Representatives will not be liable and excludes all liability under these Terms and Conditions, in tort, statute or in any other way for all injury, illness, damage or loss of any kind whatsoever directly or indirectly sustained by you in relation to a participating in any class, workshop, consult or otherwise entering Mond Women.
b. You hereby release Mond Women and its Representatives from all claims relating to participating in any class, workshop or from otherwise entering Mond Women.
23. In the event that clause 24 is not enforceable for any reason, then our maximum aggregate liability arising from or relating to any claim by you, howsoever arising shall not exceed the class attendance fees paid by you to us during the past 12 months.
24. You hereby indemnify Mond Women, and its Representatives, from all direct, reasonable and quantifiable loss or damage suffered by Mond Women and/or its Representatives as a result of you breaching these Terms and Conditions.
25. We use the “Mond Women '' logo brands as trademarks in connection with our Services, and we are also the exclusive owner of logos, artwork, photographs, videos, instruction manuals, teaching materials, instructional compilations, website designs and other materials created to promote our Services . You shall not be permitted to copy, reproduce, sell, distribute, licence or otherwise use the Mond Women IP unless you must obtain our prior written consent (which may be withheld by us in our absolute discretion).
26. Any unenforceable or void provision, or part thereof, may be severed from these Terms and Conditions without affecting the validity of the remaining provisions.
27. These Terms and Conditions shall be governed by the laws of New South Wales, Australia, and the parties submit irrevocably to the authority of courts having jurisdiction in New South Wales, Australia.
28. We are able to novate, assign, sub-licence or otherwise transfer our rights and obligations under these Terms and Conditions to a third party nominated by us provided the third party continues to fulfil its obligations to you under these Terms and Conditions. You agree that where we do so, the new party will assume our rights and obligations under these Terms and Conditions (in whole or in part) and you will release us from those rights and conditions under these Terms and Conditions.
29. CLASSES & PACKAGES
For any class packages, the date of activation of the package will occur when you first book attendance to a class using the Online Booking System.
Mond Women class packages will expire after 6 months from the date of activation of the package.
If a Promotional Code is provided to an individual or business, enabling the individual/employees to receive a discounted or complimentary offer, the code must not be shared with persons outside that organisation. Mond Women reserves the right to cancel a complimentary or discounted offer/s if they believe this to be the case.
Private Classes
Confirmation of Private Class booking is secured upon payment. If requiring cancellation, you must process a cancellation through the Online Booking System only. In order to cancel your attendance without penalty, you must process a cancellation using the Online Booking System up to 16 hours prior to the scheduled commencement time for the class as detailed in our Class Schedule (“Early Cancellation Window”). We will not accept cancellations by phone, e-mail or any other method other than by using the Online Booking System.
32. Covid Protocols
You must have checked into the Mond Women studio, using the NSW government QR code. You must use the hand sanitizer provided before entering the studio.
Upon finishing your class please use the cleaning material provided to clean your equipment and props. As per NSW Health guidelines, you are permitted to continue to wear a mask or remove it during your yoga class, but please reapply your mask at any time including final resting pose.
We request you please do not come to class if you are unwell and we reserve the right to refuse your entry into class, if you appear to have cold or flu like symptoms in an effort to protect our instructors and clients.
Please contact us immediately if you have tested positive to a Covid test and recently taken class at the studio.
33. Refund Policy
Any apparel or gift purchases made through the studio online or otherwise, have a no returns policy due to the small quantity of this category at Mond Women. Yoga class purchases are also non-refundable and unused passes will expire 6 months from purchase date, unless otherwise notified or organised through the studio via email.
34. Cancellation Policy
Please note that both private and semi-private classes require 16hrs cancellation as an “Early Cancellation” through the Online Booking System, or the class payment will be taken in full.
35. Privacy Policy
If you register on the Website, you will be required to choose a password and username, and you may be asked for additional information regarding your account, such as your email address. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Mond Women of any unauthorised use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. You may never use another person's account without prior authorization from Mond Women. Mond Women will not be liable for any loss or damage arising from your failure to comply with this Agreement.
Mond Women respects your privacy and permits you to control certain aspects of the treatment of your personal information as set forth in Mond Women‘s Privacy Policy. A complete statement of the current privacy policy can be found in Mond Women’s Privacy Policy. The Privacy Policy is expressly incorporated into this Agreement by this reference.
